FAILURE

A patent application for an invention will fail to be granted if the application fails to comply with the Patents Act for any reason.

FIGURATIVE MARK

A Figurative Mark is a Trade Mark, which is composed of figures which can take the form of non-standard characters or a graphic feature in any colour, layout or style. Figurative Marks can include a combination of text and figurative elements.

FILING

The process of submitting your patent, design or trade mark application to the patent office.

FURTHER PROCESSING

Certain deadlines relating to a European patent application, in particular deadlines which have been set by the European Patent Office, may be extendible by two months as of right.

Further processing is available to the applicant only and can be used where there is a partial or total loss of rights. Further processing can be used, for example, to extend the time in which to pay the search fee or filing a response to an examination report. However, depending on what the deadline is, a fee may be payable. The fee payable may relate only to the further processing fee. However, where the request for further processing concerns the late payment of official fees, then 50% of the official fee is payable in addition to the original fee.
